1.About these terms
These terms are an agreement between you and CodexIndia Technology Solutions, which runs Hostracer at hostracer.in (“Hostracer”, “we”, “us”). They apply whenever you create an account, place an order or use any service we provide — web hosting, VPS, domain names, SSL and support.
By creating an account or placing an order you confirm that you have read and accept these terms, our Privacy Policy and our Refund Policy. If you accept on behalf of a business, you confirm you are authorised to bind it.
2.Your account
- You must be at least 18 years old and able to enter a binding contract under Indian law.
- Give us accurate, current details — name, email address, mobile number and billing address — and keep them up to date. We verify your mobile number with a one-time password sent by SMS.
- Keep your password and one-time codes private. You are responsible for everything done through your account, so tell us straight away if you think someone else has access to it.
- We may ask for proof of identity or address before activating or continuing a service — for example to prevent fraud, or where Indian law (such as CERT-In directions for VPS customers) requires us to hold validated customer details. If you can’t provide it, we may decline or cancel the order and refund it.
3.Orders and delivery
- Every service we sell is delivered online. Nothing is shipped.
- An order is confirmed once payment succeeds. Most hosting and VPS orders are set up automatically and the login details are emailed to you; if an order needs a manual check, we’ll tell you.
- A domain registration or transfer is confirmed only when the registry accepts it. If it can’t be completed, we refund what you paid for it.
- We may decline or cancel an order — for example for suspected fraud, incorrect details or an obvious pricing error — and refund what you paid for it.
- Each plan includes the features described on our website when you ordered it.
4.Prices, payment and GST
- Prices are in Indian rupees and exclude GST. GST (currently 18%) is added at checkout and shown on your invoice. Add your GSTIN in your account settings so your invoices carry it for input tax credit.
- Hosting and VPS are paid in advance for the term you choose — monthly, or one, two or four years.
- Payments are processed by Razorpay. We never see or store your full card number, CVV, UPI PIN or net-banking password.
- Offers and coupon codes apply only as stated with the offer — a first-order coupon, for instance, applies to your first order only. They have no cash value.
- If a payment is reversed or charged back, we may suspend the related service until the matter is resolved.
5.Renewals and cancellation
- Services renew for the same term. We raise a renewal invoice before the due date and email it to you; the service continues once it is paid. We don’t store your card to charge it automatically.
- Hosting and VPS renew at the plan’s price for the same term, which is printed on every plan on our pricing page. Domain names renew at the renewal price listed on our domains page, which for some extensions is higher than the first-year price.
- If a renewal invoice isn’t paid by its due date, the service may be suspended and later terminated, and its data deleted. Domains that aren’t renewed expire under the registry’s rules (see Domain names).
- You can cancel any service at any time by opening a support ticket. Cancelling stops future renewals. Unless our Refund Policy says otherwise, payments already made for the current term are not refunded.
6.Acceptable use
You must not use our services, or let anyone else use them, to:
- break any law in force in India — including the Information Technology Act, 2000 and the rules made under it — or the law that applies to you or your visitors;
- host, link to or distribute child sexual abuse material. We report it to the authorities;
- infringe anyone’s copyright, trademark or other rights, including pirated software, films or music;
- send spam or unsolicited bulk email or SMS, or host sites promoted that way;
- run phishing pages, malware, botnets or command-and-control servers, or scan, flood, break into or attack any system, including ours;
- publish content that is obscene, defamatory, threatening or harassing, that promotes violence or hatred against any group, or that is otherwise prohibited under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
- run open proxies, open mail relays or public file mirrors, or mine cryptocurrency on shared or reseller hosting;
- resell our services, except on a reseller plan;
- get around our limits, security measures or billing.
You are responsible for everything on your account, including content uploaded by your own customers or site visitors. Keep software such as WordPress and its plugins up to date — a compromised site that attacks others may be suspended until it is cleaned.
When we receive a valid order from a court or government agency, or a complaint the law requires us to act on, we may remove or disable access to content and share information as the law requires.
7.Fair use of resources
Words such as “unlimited” and “unmetered” on shared hosting mean we don’t set a fixed cap for normal website use — not that a server has infinite capacity. Each shared server is used by many customers, so one account must not use so much CPU, memory, disk activity or storage that it slows down the others. Storage is for your website and its email, not for backups of other systems, file sharing or media archives.
If your account is affecting others, we’ll contact you first where we can, and may ask you to optimise the site or move to a larger plan or a VPS. In an emergency we may limit the account straight away to protect the server.
8.Your content, backups and migration
- You own the content you put on our servers. You allow us to store, copy and transmit it only as needed to run the service, make backups and comply with the law.
- Where a plan includes backups, they are there to help recovery, not a guarantee. Keep your own up-to-date copies of anything important; we are not responsible for lost data, including data deleted after a service ends.
- Free website migration, where your plan includes it, is carried out when you ask for it through a support ticket. You’ll need to give us access to your old host, and you should check the migrated site before pointing your domain at it. How migration works.
9.Domain names
- We register domains through an accredited registrar partner. Every domain is also subject to the policies of ICANN and of the registry that runs its extension — for example NIXI for .in and .co.in. By registering a domain you agree to those policies.
- Domains are registered first come, first served. A domain is yours only once the registry confirms the registration; until then someone else may take it.
- You must give accurate registrant contact details. Registries require them and may publish them in WHOIS/RDAP. We provide free WHOIS privacy where the registry allows it — .in does not. The registrant email address must be verified; a domain can be suspended if it isn’t verified in time.
- Renewing a domain is your responsibility. If it isn’t renewed in time it expires, and the registry’s grace and redemption periods then apply — restoring a domain from redemption carries an extra registry fee. After that it may be released for anyone to register.
- Transfers follow registry rules, such as the 60-day lock after a registration or a previous transfer. Registrations, renewals and completed transfers are non-refundable once the registry has processed them (see the Refund Policy).
- Disputes over a domain name are decided under the registry’s dispute policy — the UDRP for generic extensions such as .com, and the .IN Domain Name Dispute Resolution Policy (INDRP) for .in. We follow any decision or court order made under them.
10.Suspension and termination
We may suspend or terminate a service — with notice where practical — if:
- an invoice for it is unpaid after its due date;
- you break these terms, in particular the acceptable use rules;
- the service puts our network, other customers or anyone else at risk;
- a court, government agency or the law requires it; or
- you have given us false information, or we reasonably suspect fraud.
Where the problem can be fixed — an unpaid invoice, a hacked site — we restore the service once it is. If we terminate a service for a serious breach, the rest of the term is not refunded. Once a service is terminated, its files, databases and email may be deleted and cannot be recovered.
11.Liability
We work hard to keep every service running, but we can’t promise it will be uninterrupted or error-free. Services are provided “as is”; maintenance, network faults and events outside our control can cause downtime.
To the extent Indian law allows:
- we are not liable for indirect or consequential loss, such as lost profits, revenue, business, goodwill or data; and
- our total liability for any claim about a service is limited to the amount you paid us for that service in the three months before the event that gave rise to the claim.
Neither of us is responsible for a failure caused by events beyond reasonable control, such as natural disasters, failures of power or networks upstream of us, or government action. Nothing in these terms limits liability that the law does not allow to be limited, or your rights as a consumer under the Consumer Protection Act, 2019.
12.Indemnity
You agree to compensate us for claims, losses and reasonable costs (including legal fees) arising from your content, your use of the services, or your breach of these terms or of the law.
13.Changes to these terms
We may update these terms from time to time; the date at the top shows when they last changed. For changes that materially affect you, we’ll tell you by email or in your dashboard before they take effect. Continuing to use the services after a change takes effect means you accept it.
14.Governing law and disputes
These terms are governed by the laws of India. If something goes wrong, please contact us first — most problems are solved fastest through support. Subject to that, the courts having jurisdiction over the principal place of business of CodexIndia Technology Solutions have exclusive jurisdiction, without affecting any right you have as a consumer to approach a consumer commission.
15.Grievance officer and contact
In line with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints about content hosted on our services, or about these terms, can be sent to our Grievance Officer at info@hostracer.in. Please include the web address of the content, what it is and why you think it should be removed. We acknowledge complaints within 24 hours and resolve them within 15 days, as those rules require.
For anything else, email info@hostracer.in, call +91 85094 35513 (24×7, every day of the year) or visit support.
